1. Introduction

These Buyer Terms ("Terms") govern your purchase and use of products from theMOB Smart Multi Currency marketplace ("Platform"), operated by Mobatly Properties (PTY) LTD.

By purchasing products on our Platform, you agree to these Terms, our general Terms of Service, and our Privacy Policy.

Our Platform connects you with independent vendors who create and sell software products. While we facilitate transactions and provide dispute resolution, vendors are responsible for the products they sell.

2. Purchasing Products

2.1 Product Information

Before purchasing, please carefully review:

  • System requirements and compatibility
  • Documentation and usage instructions
  • Vendor ratings and reviews
  • Support terms and period
  • License type and restrictions

2.2 Pricing

All prices are displayed in USD. Prices are set by vendors and may change at any time. The price at the time of purchase is final.

2.3 Payment

We accept payments through PayPal and major credit cards. By making a purchase, you represent that you are authorized to use the payment method provided.

3. License and Usage Rights

3.1 License Grant

When you purchase a product, the vendor grants you a license to use the product according to the specified license terms. This is a license, not a transfer of ownership.

3.2 License Types

Common license types include:

  • Single Site License: Use on one website or project
  • Multi-Site License: Use on a specified number of sites
  • Developer License: Use on unlimited client projects

Always check the specific license terms on the product page before purchasing.

3.3 Prohibited Uses

You may NOT:

  • Redistribute, resell, or share the product
  • Use the product on more sites than your license allows
  • Remove or modify copyright notices or license keys
  • Use the product for illegal purposes
  • Reverse engineer or create derivative works (unless permitted by license)

4. Product Support

4.1 Support Entitlement

Your purchase includes support from the vendor for 6 months. Support includes:

  • Assistance with installation and configuration
  • Bug fixes and technical issue resolution
  • Answers to product-related questions

4.2 Response Time

Vendors are expected to respond to support requests within 48 hours. Response times may vary based on time zones and vendor availability.

4.3 Support Limitations

Support does NOT include:

  • Product customization beyond documented features
  • Third-party plugin or theme conflicts
  • Server configuration or hosting issues
  • General development training
  • Support after the support period expires

5. Refund Policy (Seller Protection)

⚠️ Important: We operate a seller-protected refund policy. Refunds are not automatic and require you to first work with the vendor to resolve any issues.

5.1 Issue Resolution Process

If you experience a problem with a purchased product:

  1. Report the Issue (Required)
    Contact the vendor through the Platform's support system within 14 days of purchase.
  2. Vendor Response
    The vendor has 3 days to respond and work with you to resolve the issue.
  3. Resolution Attempt
    Work with the vendor to fix the problem. Most issues can be resolved with vendor assistance.
  4. Escalation (If Needed)
    If the vendor fails to respond or resolve the issue within 14 days, you may escalate to Platform support.
  5. Platform Review
    We will review the case and make a decision within 7 days.

5.2 Refund-Eligible Situations

Refunds may be approved when:

  • The product is fundamentally broken and the vendor cannot or will not fix it
  • The product significantly differs from its description
  • The vendor is unresponsive for more than 3 days
  • The vendor's account has been terminated
  • Security vulnerabilities exist that the vendor refuses to address

5.3 Refund NOT Eligible

Refunds will NOT be approved for:

  • Change of mind or no longer needing the product
  • Purchasing the wrong product
  • Lack of technical skills to use the product
  • Product works as described but doesn't meet your expectations
  • Requests for features not included in the product
  • Third-party conflicts (other plugins, themes, or hosting issues)
  • Failure to read the product description or requirements
  • Requests made after 14 days from purchase
  • Not attempting to resolve issues with the vendor first

5.4 Why This Policy?

This policy protects our vendor community from fraudulent refund requests while ensuring you receive working products. It encourages communication and problem-solving, which benefits everyone.

6. Product Updates

6.1 Updates During Support Period

During your support period, you are entitled to receive product updates, including bug fixes, security patches, and compatibility updates at no additional cost.

6.2 After Support Period

After your support period expires, you may continue to use your current version. Access to new updates may require renewing your support subscription.

7. Your Responsibilities

As a buyer, you are responsible for:

  • Reading product descriptions and requirements before purchasing
  • Ensuring your system meets the product requirements
  • Following installation and usage documentation
  • Backing up your website before installing new products
  • Communicating clearly with vendors when seeking support
  • Respecting license terms and usage restrictions
  • Providing accurate information when reporting issues

8. Disputes

If you have a dispute with a vendor that cannot be resolved through normal support channels, you may request Platform mediation.

To file a dispute:

  1. Ensure you have first attempted to resolve the issue with the vendor
  2. Document all communication with the vendor
  3. Contact Platform support with your order details and issue description
  4. Provide any relevant screenshots, error messages, or evidence

Platform decisions on disputes are final and binding.

9. Intellectual Property

Products purchased from the Platform are licensed, not sold. You acquire the right to use the product according to its license terms. All intellectual property rights remain with the vendor.

You may not claim ownership of, or intellectual property rights to, any product purchased from the Platform.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBATLY PROPERTIES (PTY) LTD AND VENDORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF PURCHASED PRODUCTS.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT IN QUESTION.

Products are provided "as is" and we do not guarantee that they will meet all your requirements or work in all environments.

11. Account Termination

If your account is terminated for violation of our terms:

  • You lose access to product downloads and updates
  • Active support requests may be cancelled
  • No refunds will be provided for products already purchased
  • License rights may be revoked for serious violations

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or Platform notification. Your continued use of the Platform after changes constitutes acceptance.
