Affiliate Program Terms

Welcome to the MOB Smart Multi Currency Affiliate Program ("Program"), operated byMobatly Properties (PTY) LTD. This Agreement ("Agreement") outlines the terms under which you ("Affiliate", "you", or "your") may participate in our Program.

By joining our Affiliate Program, you agree to these terms, our Terms of Service, and our Privacy Policy.

To participate in our Affiliate Program, you must:

• Be at least 18 years old
• Have a valid website, blog, social media presence, or email list
• Have a valid PayPal account for receiving commissions
• Agree to and comply with these terms
• Not be located in a country where participation would violate local laws

We reserve the right to accept or reject affiliate applications at our sole discretion.

3.1 Commission Rate

You will earn 20% commission on all qualifying sales made through your affiliate links.

3.2 Qualifying Sales

A sale qualifies for commission when:

• The customer clicks your affiliate link and makes a purchase
• The purchase is completed within the cookie duration period
• The customer does not request and receive a refund
• The sale is not flagged as fraudulent

3.3 Cookie Duration

Our affiliate tracking cookie lasts for 30 days. If a customer clicks your affiliate link and makes a purchase within 30 days, you earn the commission — even if they didn't purchase immediately.

3.4 Last-Click Attribution

We use last-click attribution. If a customer clicks multiple affiliate links before purchasing, the commission goes to the affiliate whose link was clicked last.

4.1 Payout Schedule

Affiliate payouts are processed on a NET15 basis, typically 15 days after the end of each payment period.

4.2 Minimum Payout Threshold

The minimum payout threshold is $50. Commissions below this amount will be carried forward to the next payment period.

4.3 Payment Method

All affiliate payments are processed via PayPal. You must maintain a valid PayPal email address in your affiliate profile. PayPal fees, if any, are your responsibility.

4.4 Refunds and Chargebacks

If a referred customer receives a refund or initiates a chargeback, the commission for that sale will be deducted from your pending or future earnings.

4.5 Tax Responsibilities

You are solely responsible for reporting and paying all applicable taxes on your affiliate earnings. We may request tax forms (W-9, W-8BEN) as required by law.

5.1 Approved Promotional Methods

You may promote products using:

• Your personal website or blog with honest reviews
• Email marketing to your own subscribers (with proper consent)
• Social media posts on platforms where you have an established presence
• YouTube videos, podcasts, or other content you create
• Online communities where promotion is permitted by community rules

5.2 Required Disclosures

You must clearly disclose your affiliate relationship in all promotional content. This is required by the FTC and similar regulations worldwide. Examples of proper disclosure:

• "This post contains affiliate links. I may earn a commission if you make a purchase."
• "Affiliate disclosure: I am a paid affiliate of [Platform Name]."
• "#ad" or "#affiliate" in social media posts (where appropriate)

5.3 Prohibited Promotional Methods

The following promotional methods are strictly prohibited:

• Spam: Unsolicited emails, comments, or messages
• Misleading Claims: False or exaggerated product claims
• Trademark Bidding: Bidding on our brand name or product names in paid ads
• Cookie Stuffing: Forcing affiliate cookies without user knowledge
• Incentivized Clicks: Paying or rewarding users to click affiliate links
• Pop-ups/Pop-unders: Intrusive advertising methods
• Coupon/Deal Sites: Creating fake coupon or deal sites (without approval)
• Impersonation: Pretending to be us or our employees
• Negative Marketing: Disparaging competitors in misleading ways

6.1 Use of Marketing Materials

We may provide banners, logos, and other marketing materials for your use. You may only use these materials as provided and may not modify them without permission.

6.2 Trademark Usage

You may use our trademarks (MOB Smart Multi Currency, MOB Smart Currency) only to identify and promote products on our Platform. You may not:

• Use our trademarks in your domain name
• Use our trademarks in a way that suggests endorsement
• Modify or alter our logos or branding
• Use our branding in paid advertising without approval

Self-referrals (using your own affiliate link to purchase products for yourself) are not permitted. Self-referral commissions will be voided, and repeated violations may result in account termination.

We reserve the right to modify any aspect of the Affiliate Program at any time, including:

• Commission rates
• Cookie duration
• Payout thresholds and schedules
• Promotional guidelines
• Eligible products

We will notify you of material changes via email or through your affiliate dashboard. Your continued participation after changes constitutes acceptance.

9.1 Termination by You

You may terminate your participation in the Program at any time by contacting us. Pending commissions above the minimum threshold will be paid according to the normal schedule.

9.2 Termination by Us

We may terminate your participation at any time for any reason, including but not limited to:

• Violation of these terms or promotional guidelines
• Fraudulent activity or abuse of the Program
• Extended inactivity (no referral activity for 12 months)
• Engaging in prohibited promotional methods
• Damage to our brand or reputation

9.3 Effect of Termination

Upon termination:

• All pending commissions below the minimum threshold are forfeited
• You must immediately stop using our marketing materials
• You must remove all affiliate links from your properties
• Commissions above the threshold will be paid if termination is not for cause

In cases of fraud or serious violations, all pending commissions may be forfeited.

You are an independent contractor, not an employee, partner, or agent of Mobatly Properties (PTY) LTD. You have no authority to make commitments on our behalf.

This Agreement does not create any employment relationship, and you are not entitled to any employee benefits.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBATLY PROPERTIES (PTY) LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR PARTICIPATION IN THE AFFILIATE PROGRAM.

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE TOTAL COMMISSIONS EARNED BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless Mobatly Properties (PTY) LTD from any claims, damages, losses, or expenses arising from:

• Your promotional activities
• Your violation of these terms
• Your violation of any laws or regulations
• Any content you create regarding our products

You agree to keep confidential any non-public information about the Affiliate Program, including commission rates, conversion data, and any other proprietary information shared with you.
